Law

Research conducted by Capacity Global suggests that within the EU, vulnerable groups carry a disproportionate burden of environmental hazards. Our findings also show that this same group of people are excluded from access to the mainstream legal system, specifically within the UK.

In order to tackle this inequality in access to justice Capacity Global has developed a range of projects that encourage the development and use of the law, as a means of attaining environmental justice. Driven by the Aarhus Convention much of our work has been focused on promoting the use of procedural elements of environmental justice, such as access to information and public participation, both areas of law are firmly established within the European Union (EU).

Below are details of our legal projects.

CAJE

CAJE is a network of organisations who lobby and advocate for the improvement of environmental law and legal systems.  Capacity Global, World Wildlife Fund (WWF), the Environmental Law Foundation (ELF), Greenpeace, Friends of the Earth and the Royal Society for the Protection of Birds (RSPB) make up its present membership. Working together the network reviews the operation of environmental law in England and Wales, identifying inadequacies with regard to access to justice.

Environmental Justice in Europe - EJ.EU

This groundbreaking programme of work is designed to tackle environmental inequality by improving access to environmental justice across Europe. Developed by Capacity Global EJ.EU provides a forum for information, discussion and research that encourages European Union institutions to integrate environmental equality into policy and law.  EJ.EU is currently exploring the possibility of using European ‘discrimination’ laws to improve quality of life for those communities most vulnerable to the impacts of environmental degradation.
